The Freedom of Information (FOI) process is a part of the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA). This legal process was designed to make sure that all requests for access are treated fairly and objectively. MFIPPA sets out that information should be made available to the public, and that certain types of records such as personal privacy of others, trade secrets, lawyer-client privilege, etc. must be protected.
Before filing your request you should contact the City Clerk or Deputy City Clerk to see if a request is necessary.
The Information and Privacy Commissioner of Ontario (IPC) is a neutral third party who, upon appeal, review records and the law to determine whether an access decision by the City will be upheld, or, determine the appropriate decision.

Law enforcement agencies such as the North Bay Police Service, Ontario Provincial Police, the Children Aid Society, etc. may request information from the City to aid in an investigation.
Records routinely available to the public are also available to any law enforcement agency subject to any relevant conditions. Records containing personal information may also be disclosed to a law enforcement agency.
Only law enforcement agencies are able to request this footage.Any type of request for video surveillance are to be forwarded to the City Clerk and Deputy City Clerk.
Internally, the City Clerk's Office organize the coordination of video review between the internal staff and the requesting agency to ensure that the privacy of individuals is protected.
Once the footage is reviewed by the City Clerk's Office, the information is then released to the requesting agency.

Note: Where an agency does not have the necessary technology in place to protect the personal information of individuals, any requests involving personal, confidential or third party information will require a subpoena or court order prior to release.

Until further notice, the "In Person" method of receiving requests has been suspended due to the pandemic. We invite you to submit your form via mail, via online submission, or via email to the City Clerk or Deputy City Clerk. You may remit the application fee by delivering or mailing a cheque, or delivering cash in a clearly marked envelope and depositing it in our Drop Box at City Hall.
